London and Paris Holiday Competition
(“Competition”)
Terms and Conditions
  1. Information on how to enter and the prizes forms part of the terms and conditions of entry. Participation in the Competition is deemed acceptance of these terms and conditions.
  2. The promoter is Expedia Australia Pty Ltd ACN 101 694 946 of Level 5, 95 Pitt Street, Sydney NSW 2000 (“Promoter”).
  3. The sponsors are Cathay Pacific Airways, French Tourist Bureau, British Tourist Authority trading as VisitBritain and The Walshe Group (together the “Sponsors”).
  4. Subject to clauses 5 and 6 below, entry is open to all residents of Australia.
  5. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter the Competition.
  6. Employees and their immediate family members) of the Promoter, the Sponsors and any of their associated agencies, suppliers or related bodies corporate are not eligible to enter this Competition.
  7. The Competition commences on Tuesday 19th February 2008 at 00:01 (AEDT) and concludes on Thursday, 15 May 2008 at 23:59 (AEDT). No responsibility is accepted for late, lost or misdirected entries.
  8. To enter the Competition and to be eligible to win, participants must log onto http://www.expedia.com.au/visit-france-uk/competition.aspx and register their details including, without limitation, his or her name, e-mail address, and must otherwise comply with these terms and conditions. Failure to provide the requested information will render the entry invalid.
  9. A limit of one entry per person will apply. Any participant who enters more than once will have all entries apart from their original entry on that day deemed invalid. Entrants will be given the opportunity to “Refer a Friend” by sending up to 3 friends an email that contains a hyperlink to the promotion. The entrant will receive one entry into the draw for each friend referred.
  10. There is one prize to be awarded to one entrant in the Competition. The prize winner chosen will be awarded the following prize:
    (a) return economy class airfares to Paris or London for two people departing from Sydney, Melbourne, Brisbane, Adelaide, Perth or Cairns (“Flight Departure Cities”);
    (b) 2 x leisure select tickets for Eurostar; departing either London or Paris.
    (c) 3 nights’ accommodation in a minimum 3 star hotel in Paris, plus Metro card tourist passes which include 2 x Intermusees Museum Passes and 2 x Paris Visite Pass;
    (d) 3 nights’ accommodation in a minimum 3 star hotel in London, 2 x London passes and 2 x Oyster cards.
  11. The winner and his/her travelling companion must depart from the same airport on the same flight. Subject to paragraph 13 below, the winner and his/her travelling companion are responsible for transport from their residence to the nearest Flight Departure City.
  12. If the winner resides in Tasmania, the ACT or the Northern Territory, connecting flights from the winner’s nearest capital city to the nearest Flight Departure City will be provided for the winner and travelling companion only.
  13. The total prize value is approximately AU$10,000 (including GST). Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
  14. The prize must be booked, ticketed and taken by 29th May 2009. The prize is not available during peak times such as public holidays and school holidays (if applicable), is subject to hotel and flight availability and cannot be changed once the booking has been made.
  15. If for any reason whatsoever the winner is unable to take any element of the prize at the time specified by the Promoter, then that element of the prize in its entirety will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  16. The prize is not transferable to another individual and is not exchangeable or redeemable for cash, goods or services. The prize is not refundable. The prize winner cannot change, vary, substitute or extend any element of the prize (in whole or in part).
  17. The Promoter, the Sponsors and their associated agencies, and other contractors associated with this Competition accept no responsibility for prizes lost in transit.
  18. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
  19. The prize winner and his/her travel companion are responsible for all other expenses including, without limitation, spending money, meals, transfers, activities (unless specified), incidentals, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.
  20. Frequent flyer or other reward program points are not available in relation to any element of the prize.
  21. Accommodation selection, location and room type and air carrier selection and routing is at the sole discretion of the Promoter and the Sponsors.
  22. The traveller’s must ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.
  23. The Promoter and the Sponsors make no representation as to the safety, conditions or other issues that may exist at any destination.
  24. To the extent permitted by law and any direction of the relevant gaming authority, if the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
  25. If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.
  26. The prize winner will be drawn at random from the pool of eligible entrants who have submitted an eligible entry during the promotional period. The draw will take place at the offices of Belong Pty Ltd ACN 125 822 086, Level 8, 155 George Street, Sydney NSW 2000, on Thursday, 29 May 2008 at 10:00 (AEDT).
  27. The prize winner will be notified by email within 2 days of the draw advising them of their prize. Notice of the prize winner will also be published in the Public Notices section of The Australian newspaper on Thursday, 5 June 2008.
  28. If a winning entry is deemed by the Promoter not to comply with these conditions of entry, the entry will be discarded and a new winner of the prize will be determined from those entries eligible to receive the prize.
  29. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid.
  30. If an entrant’s contact details change during the promotional period, the entrant must promptly notify the Promoter of the relevant change. A request to access or modify any information provided in an entry should be in writing and directed to Promoter.
  31. Subject to any written direction given under regulation 37 of the Lotteries and Gaming Act 1993 (SA), an unclaimed prize draw will take place at the offices of Belong Pty Ltd ACN 125 822 286, Level 8, 155 George Street, Sydney NSW 2000 on Friday, 19 September 2008 at 10:00 (AEDT) the prize winners details will be published in the Public Notices section of The Australian newspaper on Friday, 26 September 2008.
  32. The decision of the Promoter in relation to the conduct of the Competition and the prize winner is binding and final and the Promoter will not enter into any correspondence regarding the Competition result.
  33. The Promoter reserves the right to require the winner to provide proof of identification and/or proof of residency or address details in order to claim the prize. Proof of identification, residency and address considered suitable for verification is at the discretion of the Promoter. If a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute or cash will be awarded in lieu of the prize.
  34. The Promoter reserves the right to disqualify any entry which, in the opinion of the Promoter, contains objectionable content, profanity, potentially insulting, or defamatory statements or if the entry does not comply with these Terms and Conditions. The Promoter also reserves the right to, in its sole discretion, disqualify any entrant whom the Promoter believes has tampered with the entry process or has engaged in conduct in relation to the Competition that the Promoter believes to be fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter.
  35. The prize winner must comply with all the conditions of use of the prize and the prize supplier's requirements. The prize winner and his/her travelling companion may also be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  36. To the extent permitted by law, no responsibility will be accepted by the Promoter, the Sponsors, their related bodies corporate, employees, or suppliers to the Promoter (together the “Parties”) for any late, lost or misdirected entries or for any claim arising from the conduct of the Competition. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
  37. To the extent permitted by law, the Parties and its associated agencies and companies associated with this Competition, will not be liable for any for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, misadventure, accident, personal injury, death, damage or claim which is suffered or sustained (whether or not arising from any person’s negligence) in connection with:
    (a) undertaking any travel connected with the Competition or any prize won;
    (b) any act or omission (whether negligent or not) of the Parties, or any person associated with any of them; or
    (c) due to circumstances outside the Parties’ reasonable control.
  38. To the extent permitted by law, if for any reason this Competition is not capable of running as planned, due to causes including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the competition, and recommence it from the start on the same conditions subject to any government regulation.
  39. In the case of the intervention of any outside person or event which changes the result or prevents or hinders the determination of the Competition, including but not limited to vandalism, power failures, tempests, acts of terrorism, natural disasters, civil unrest, strikes or any other event beyond the control of the Promoter; the Promoter may in its discretion cancel, terminate, modify or suspend the Competition and recommence it from the start on the same conditions subject to any government regulation.
  40. All entries become the property of the Promoter. To facilitate your participation, the Promoter may disclose your personal information to other companies associated with this promotion. If the information requested is not provided, you may not enter this promotion. By entering the Competition, unless otherwise advised, each entrant acknowledges and agrees that they consent to the Promoter and the Sponsors (excluding Eurostar) collecting their personal information and that the entrant consents to the Promoter and the Sponsors (excluding Eurostar) using such information for future promotional and marketing activities including, without limitation, sending the entrant electronic messages.
  41. In relation to Eurostar, by opting-in when entering the Competition, each entrant acknowledges and agrees that Eurostar may use the entrants information for future promotional and marketing activities including, without limitation, sending the entrant electronic messages.
  42. If an individual no longer consents to their details being used for promotion and marketing purposes, the entrant should contact the Promoter or relevant Sponsor (whichever the case may be).
  43. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
  44. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created in connection with the winner’s participation in any aspect of the prize (“Works”). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
  45. Entrants’ personal information may also be disclosed to State and Territory lottery departments or to another government authority, as required by law. A request to access, update or correct any personal information should be directed to the Promoter or the relevant Sponsor.
  46. AUTOMATIC OPT-IN: By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter and benefiting parties (Expedia, VisitBritain and French Tourist Bureau) may use this information, in any media, for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
  47. STANDARD OPT-IN: All entries become the property of The Promoter and benefiting parties (Cathay Pacific and The Walshe Group). All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
